AI Summary

This video provides a comprehensive guide on crypto trading taxation in India, covering the distinction between spot trading and futures and options (F&O) in crypto. It explains the 30% flat tax on spot trading profits under Virtual Digital Assets (VDA) and the slab-rate taxation for crypto F&O, along with step-by-step instructions for ITR filing using reports from exchanges like Delta Exchange and Binance.

[00:01]
Overview of Crypto Taxation

The video covers crypto trading tax, ITR filing, and explains whether 30% tax or slab rate applies, plus how to download reports from exchanges.

[00:39]
Spot vs F&O Crypto Trading

Spot trading involves buying actual coins (Bitcoin, Ethereum) and profits are taxed at 30% under VDA. F&O trading involves contracts, not actual coins, and is taxed at slab rates.

[01:06]
Tax on Spot Trading

Spot trading profits are taxed at a flat 30% under VDA. Losses cannot be set off or carried forward. TDS of 1% under 194S is deducted.

[01:59]
Tax on Crypto F&O

Crypto F&O is outside VDA, so no 30% tax. Profits are taxed as business income at slab rates. If total income is below ₹12 lakh, no tax is payable.

[02:42]
Downloading Reports from Exchanges

Delta Exchange provides ready-made tax reports showing net profit and turnover. Binance requires downloading trade history from data center and uploading to tools like CoinX or Cloud AI.

[03:34]
ITR Filing for Crypto F&O

Use ITR-3 form. For F&O, select speculative or non-speculative business. Enter turnover and net profit/loss in relevant schedules. Expenses like courses can be claimed.

[04:00]
Speculative vs Non-Speculative Treatment

Crypto F&O can be treated as speculative (like intraday) or non-speculative (like equity F&O). Speculative losses can be carried forward for 4 years; non-speculative for 8 years.

[07:18]
Reporting Spot Trading in ITR

Spot trading must be reported under Schedule VDA. Enter acquisition date, transfer date, sell value, and buy value. Losses are not considered; only profits are taxed at 30%.

The video clarifies that crypto spot trading is taxed at 30% under VDA with no loss offset, while crypto F&O is taxed at slab rates and can be treated as speculative or non-speculative business. Proper ITR filing requires using ITR-3 and accurately reporting turnover and profits from exchange reports.

[00:01] about crypto trading tax. Yes, along with ITF filing, I will tell you step by step how your tax is levied in it? Do I have to pay 30% tax or according to the slab rate? Plus how and where to

[00:13] how to download reports etc. Whether you can use Delta Exchange or Binance etc. for FAO. So there will be a video with complete details. Before starting the video, I would

[00:26] want to file ITR through professional experts, then the link is in the description box and you can trust over 700 plus reviews. So first let us talk about the two types of majorly crypto that I have divided here. One is your spot and one is your FN.

[00:39] Spot means that you simply buy Bitcoin for Ethereum here. Meaning, if you simply have USDT coins lying with you or if you are buying directly from IAR, then all of them are lying with you or if you are buying directly from IAR, then all of them are

[00:51] look there, whatever profit you earn is ultimately considered as virtual digital assets Whereas this is not the case within the FAO of crypto. You do not actually buy any Bitcoin or Ethereum or any stable coin or any coin. You deal within Simply Contracts.

[01:06] And all this happens inside your IAR. So basically, according to VDA, you do not have to pay 30% tax inside Crypto FAO. So brother, in spot, it is simple that whatever assets you have in your portfolio like

[01:19] Bitcoin, Ethereum etc., when you sell them tomorrow, whether you are making profit or loss, you will not have to pay any tax on the loss but reporting will have to be done and a flat rate tax of 30% will be levied on the profit. Also, when you go to sell it,

[01:33] TDS of 1% is also deducted from you under 194S. Plus you can never set off your losses if you are using Indian exchanges etc. Cannot carry forward. Suppose you made a profit of ₹ 1 lakh

[01:46] in crypto but suffered a loss of ₹ 1 lakh, then the tax you have to pay is on the entire ₹ 1 lakh. It is not that you will be able to set off the loss. But the best thing about crypto, FNO futures and options, is that you are

[01:59] dealing under contracts, so it is outside the sections of VDA, simply put, you will never be charged a flat rate tax of 30% here, just

[02:11] interest, you earn profit in business, similarly here a if I talk about slab rates in our India, then there is no tax up to Rs 4 lakh, there is 5% on 4 to 8 also, on which you get rebate and there is a tax of 10% on 8 to 12 also, on which

[02:25] you get rebate. That means, if your income is below ₹12 lakh including your FAO crypto profit, then But if there is a bead then you will have to pay

[02:42] how to download reports etc. from here. So let me So you can see in front of the screen that you get to see the report of some Delta Exchange in this way deal you have done in the future and whatever is its net profit and whatever is the

[02:57] turnover here and on the bottom side you get to see basically the things related to options. At the same time, if I talk about Binance etc., then they do not give you readymade tax panel reports. Then you can simply go to the data download center here and

[03:09] here you can see spot and future under the trade history and you can either simply upload those reports on Coinx. I will give you its exclusive discounted link inside the description box and if you do not want to use Coinx then

[03:21] you can upload it on Cloud AI and I will give you a detailed PM loss. Let me now show you live how its ITR filing is done here. So for this you will always have to fill up the ITR 3 form here.

[03:34] If you deal within the FAO of crypto then here you have to select many schedules. So simply, the selected by default. So you do n't need to do anything. So you

[03:47] can see that ITR is such a long and wide form. But here I will talk straight to the point. Where and what kind of figures etc. you have to enter here. Now see, the FAO of crypto

[04:00] is no clarification from the government on this because the FNOs of crypto still fall in the grey area. So here it is considered if you treat it as a speculative you do intraday trading in India, this is also treated in the same way.

[04:14] And suppose if you treat it like a normal business, that is, India, just like FNO is done in Indian equity in the Indian market, in the same way FNO of crypto

[04:26] is also treated here. So in this, simply if you then from this year itself the government has introduced two new options here in which you can see the turnover of FAO and how much is your profit and loss.

[04:40] So brother, whatever your Delta Exchange or whatever your simple report is, turnover is already mentioned in it. If the rest is not mentioned then let me tell you how it is calculated that

[04:52] whatever your gross profit is on each of your transactions, whatever your gross loss is, even if it is in minus, you simply add both of them here. So that together becomes your turnover. And the same thing, this same

[05:05] concept works in the FNOs of Indian Equity. So if you treat it like Indian Equity FAO, that is, if you treat it like a non-inspective business, then basically you have to simply put your turnover here in this column. And whatever your

[05:19] net profit and net loss is, you can simply put it in the column below. consultants treat it in this manner here. But some tax experts also believe that it should basically be treated like a separate business.

[05:32] So in that case you should not use these columns. If you look at the top side, you can see intraday columns. So you can use both these columns here. So if you want to show it as spective income here, then

[05:45] show it as non-spective, that is, if you want to show it as normal as a FNO, then you have to use both these columns in which you simply have to enter your turnover and whatever is your net profit and loss of FNO of crypto, you have to simply enter it here and the

[05:59] can also add other expenses in it. For example, if you have taken any course or any subscription, then you can claim these types of expenses here as a business. And if you have a loss here, then in both cases the

[06:12] That means if the total income is below Rs 12 lakh then no tax will be levied. But if you want to carry forward the losses, then in case of selective business you can carry forward it only for 4 years.

[06:24] Whereas in case of non-selective i.e. normal business, you can carry it forward for 8 years. trading account is filled up you report the turnover and profit and loss here. go inside the balance sheet and here you can see the source of funds and application of

[06:38] they have invested some of your capital etc. then you can put it here. Otherwise, you can put it here. Otherwise, And

[06:53] this way, if you check here in the Schedule BP in a simple way, then see, if you have shown it as a normal business here, then you can see here that in a simple way, you will get to see your loss or

[07:05] but if you have shown it as intraday i.e. as an inspective business, then you will see your amount in this column and here you will have to keep one more thing in also done spot trading here. Many people

[07:18] here do swing trading. Hold BTC for a few days and then sell it later. So keep in mind that you will not come inside these things. you will have to select Schedule VDA here.

[07:30] And if you go to Schedule VDA and add details here, then you have to enter the date of acquisition, date of transfer i.e. date of selling. Plus, under which head will your tax be paid here? So here you can see that a separate column for business income has been

[07:42] given here. So if you have done spot trading here then in that case it will come under VDA. But if you have dealt in derivatives where there are some contracts and you have not actually bought any coin, like

[07:54] data exchange etc. and on other platforms, then you can do the treatment as I told you. All other things of yours will always be reported here within VDA. So here you will have to enter the same sell value

[08:06] and buy value of your coins and accordingly your profit will be booked here and keep in mind that it never takes a loss. That is, let's suppose that here in a simple manner and let's suppose that I entered the buy value of ₹9 lakh

[08:20] not make any sense here because as I told you, you do not get any benefit on the loss that occurs on the video. Neither is it set off nor is if you make a profit, then in that case

[08:37] Guys hope you like this video please subscribe our channel. If you have and I have already given all the supported links in the description box. in the description box. Thank you guys. Thank you very much.
